Charges of Possession of Cocaine Against Engineer do Not Issue After Clerk Magistrate Hearing
A few weeks ago, our client, an engineer, lost his wallet. A good Samaritan found the wallet and turned it into the police. The officers opened the wallet to see if they could determine whose property it was. While doing so they located a small amount of cocaine. The officers were able to identify the man. They contacted him to let him know they had his wallet. When he went to retrieve the wallet, he was asked about the drugs. He admitted they were his and he received a summons for a clerk magistrate hearing seeking charges of possession of cocaine in violation of G.L. c. 94C §34. Today, after a hearing the clerk magistrate declined to issue the criminal complaint.
