MASSACHUSETTS FIELD SOBRIETY TESTS

When one is stopped by police and suspected of drunk driving or driving under the influence of drugs, they often ask the suspect to perform field sobriety tests. These tests can involve alphabet recitation, finger to nose testing, standing on one leg, walk- and- turn testing, and the horizontal gaze nystagmus test. Under National Highway Traffic Safety Administration Guidelines, however, only the latter three have been validated.

Even though these tests are designed to be simple, often times they are administered under circumstances that make performance very difficult. For example, persons who are elderly, nervous, or overweight or those who have some form of physical handicap or discomfort may struggle with field sobriety tests even when they are sober. Field sobriety testing is also frequently flawed if conducted under improper conditions or administered incorrectly. One should remember that if you refuse to submit to a field sobriety test, that cannot be used against one as evidence at trial.

BREATHALYZER TESTING

It is important to remember that you have the right to refuse a breathalyzer test. If you do so, then your license will be suspended for 180 days for a first offense. If you take the test and fail (by blowing a .08 or higher), then your license will be suspended for 30 days.

OUI penalties in Massachusetts are very severe and can include jail time, loss of license, alcohol education or treatment programs, large fines and court fees, and car insurance increases. Drunk driving penalties are governed by Massachusetts General Laws Chapter 90 Section 24 and 24D. The punishments grow more severe with each subsequent offense.
