Motor Vehicle Offenses

When a person violates state mandated driving laws, he/she is committing a motor vehicle offense. Most motor vehicle offenses are categorized as infractions or misdemeanors, but that does not mean that these offenses should be taken lightly. What Should I Do If the Police Ask Me to Go to the Station to Be Interviewed for a Motor Vehicle Crime?

The short answer to this question is “don’t go”. Especially without a lawyer. Chances are pretty good that if the police call you to go to the station “just to talk” they have a very weak case against you. They have certain information that they are not going to share with you. The questions they ask you are, in large part based on that information. They ask questions designed to elicit an answer that is going to get you in trouble. Trust me on this one. If they had a case against you then you would have already been arrested or received a summons.

Won’t People Think I Am Guilty If I Don’t Talk to the Police?

It doesn’t matter what people think. What matters is that you don’t inculpate yourself. If your case goes to trial the prosecution cannot comment on the fact that you didn’t speak to the police. This would be a violation of your right to remain silent under the Massachusetts and United States Constitutions. If you say nothing, and no one can say that you were driving the car then you are going to be found not guilty of the crime. So, not talking to the cops was your best decision and regardless of what people think, you will not be convicted of the crime.

Complaint Against College Student for Forging or Misusing RMV Document Does Not Issue After Clerk Magistrate Hearing August 20, 2026 Our client is a college student doing very well at a local prestigious university. Earlier this summer she went to a bar using a fake identification card. The staff at the bar identified the document as a forgery and seized it. They subsequently contacted the local police who in turn summonsed the woman for a clerk magistrate hearing charging her with Forging or Misusing a Registry of Motor Vehicles document in violation of G.L. c. 90 §24B. This is a felony in Massachusetts, something that most people are not aware of. Our office was hired to represent the woman. Today, the clerk magistrate agreed not to issue the complaint. Charges of Receiving Stolen Motor Vehicle and Receiving Stolen Property Against Truck Driver Dismissed August 14, 2026 Over a year ago a woman was perusing Facebook Marketplace and saw her motorcycle listed for sale. She contacted the police in her town who in turn notified the police in the town where the goods were listed. Officers soon learned that this item and several other similar items were being stored at a storage facility being rented by our client. The investigating officers were further able to identify our client as the individual listing the items for sale. They obtained a search warrant and located several motorcycles and other items of value. Our client was charged with receiving stolen motor vehicle under G.L. c. 266 §28 and receiving stolen property over $1,200 in violation of G.L. c. 266 §60, both felonies in Massachusetts. A conviction or even a continuance without a finding for the motor vehicle related crimes would result in a license suspension for our client. He would have lost his job. Criminal Complaint Application Against Physician for Negligent Operation of a Motor Vehicle is Denied After Clerk Magistrate Hearing June 23, 2026 Our client is a well known surgeon. In April of this year he was involved in a serious car accident. Witnesses to the crash told responding police officers that our client was driving at a high rate of speed. He unlawfully passed several vehicles crossing over the double yellow lines to do so. He crashed into a truck causing damage to both vehicles. He was cited with negligent operation of a motor vehicle under G.L. c. 90 section 24. We represented him at a clerk magistrate hearing earlier today.
