Pretrial Probation for PhD Candidate on Charges of Violation of a 209A Restraining Order and Criminal Harassment, Dismissal of Intimidation of a Witness Charge
In January of this year, our client, a PhD candidate at a prestigious local university had a falling out with a woman with whom he had a relationship. The woman got a 209A restraining order against him as a result. The police assisting her helped her obtain criminal harassment charges under G.L. c. 265 section 43A. They did this after learning that our client had a fixation on the woman, aggressively pursued her after the breakup and was delusional about their future. A few days later our client contacted woman and was charged with violating the restraining order under G.L. c. 209A section 7 and intimidation of a witness for threatening her to “drop” the charges against him or he would retaliate against her. This is a crime under G.L. c. 268 section 13B, a felony for intimidation of a witness. He was charged with this as well. Today, we were able to get the intimidation of a witness charge dismissed. Pretrial Probation under G.L. c 276 section 87 was imposed on the remaining charges. The case will be dismissed soon.
