Firearm Charges Against Former Marine Dismissed
Last summer our client, a former Marine and combat veteran was pulled over for a moving violation. The police quickly learned that his license had been suspended and that he was in violation of G.L. c. 90 section 23, an arrestable offense in Massachusetts. During the arrest the police located a loaded firearm for which our client did not have a license. He was charged with G.L. c. 269 section 10(a) and G.L. c. 269 section 10(n) for those charges. The 10(a) carries a mandatory 18 month house of correction sentence upon conviction. Our client was also charged with improper storage of a firearm under G.L. c. 140 section 131L and possession of ammunition under G.L. c. 269 section 10(h). Our office was able to get the mandatory charges dismissed. Our client then got a continuance without a finding (CWOF) for the unlawful possession of ammunition charge. All charges will be dismissed in a few months.
