Felony Strangulation Charges Against Software Consultant Dismissed and 60 Day Continuance Without a Finding For Domestic Assault and Battery Charge
Our client is a self-employed software Construction with over 30 years experience. His business is in the process of going public. In April of this year police were called to his home for a complaint of a domestic assault and battery and strangulation. The facts of the case were dubious in that the alleged victim in the case recanted on several occasions and showed no visible signs of injury when the police investigated her complaint. Unfortunately she made a 911 call that a judge deemed partially admissible or the case to go to trial. The strangulation count is a felony under G.L. c. 265 section 15D. We were able to get that count dismissed. The remaining count, domestic assault and battery under G.L. c. 265 section 13M was continued without a finding (CWOF) and will be dismissed in 60 days.
