Complaint for Trespass Against High School Student Does Not Issue After Clerk Magistrate Hearing
Our client is a student recently suspended from school for very serious threats to the school building, teachers and other students. He was charged with several crimes and given a no trespass order from the school. A few days after getting the order he violated by entering school grounds. He was given a summons for a clerk magistrate hearing seeking to charge him with trespassing under G.L. c. 266 §120. Today the clerk magistrate declined to issue the criminal complaint and the case was dismissed.
