Charges of Open and Gross Lewdness Against Firefighter do Not Issue After Clerk Magistrate Hearing
The defendant is a firefighter working for a rural town in Massachusetts. Over the course of several months, the defendant was seen masturbating in his home with his window shades open. This activity was witnessed by several people characterized as victims and witnesses. The defendant received an application for a complaint charging him with three counts of lewd, wanton and lascivious conduct in violation of G.L. c. 272 section 53. Our office was retained. Today, after a clerk magistrate hearing, the clerk agreed not to issue the complaint but rather hold the case open for a period of time. If our client remains free of criminal legal problems the complaint will not issue.
