Charges of Open and Gross Lewdness Against Bar Owner Dismissed
Our client is a local bar owner with a history of ADHD, depression and substance abuse. In February and March of this year he was observed displaying his genitalia through an open window in his apartment. The target of his actions were local female construction workers who had been working in the area for several weeks. In February when they observe this behavior they wrote it off to either aberrational or accidental conduct. Few weeks later when this happened again they realized, based on his deliberate actions that his behavior was directed towards them. The police were called and our client was ultimately arrested and charged with open and gross lewdness in violation of G.L. c. 272 section 16. Today, our office was able to get two of the counts dismissed. The remaining counts were continued without a finding (CWOF) and will be dismissed shortly,
