Charges of Negligent Operation of a Motor Vehicle Against Truck Driver do Not Issue After Clerk Magistrate Hearing
The defendant is a commercial truck driver. He typically drives tandem trailers containing goods for various Supermarket chains. A few months ago he was driving from New York to Massachusetts. He unhitched one of the trailers at a destination point. He intended to head to another destination point with the remaining trailer. While doing so he forgot that the dolly hitching the two trailers had not been removed from the trailer he was operating. Unbeknownst to him the dolly came off and struck another vehicle causing personal injury. Our client was located and confronted by the police with this issue. He accepted responsibility for the incident but maintained that he did not know that it had in fact occurred. He received a summons in the mail for a clerk magistrate hearing charging him with negligent operation of a motor vehicle in violation of G.L. c. 90 section 24. Attorney Neyman was hired to represent him. After a lengthy clerk magistrate hearing the complaint did not issue. Instead it is being held for 6 months. Provided our client does not get in any criminal legal trouble the complaint will not issue.
