Charges of Indecent Assault and Battery Against Engineer Reduced to Assault and Battery and Continued Without a Finding
Our client is an engineer who is married and has teenage children. Last summer he was at an amusement park at a beach walking through an arcade. It was alleged that while in there, he pinched the buttocks of a 15 year old girl who had bent down to pick up some coins she had dropped. Witnesses in the area identified this man as being near the girl in the arcade and quickly running out after the incident. Police located him, arrested him and charged him with indecent assault and battery in violation of G.L. c. 265 section 13H, a felony in Massachusetts. A conviction of this crime requires sex offender registration. Attorney Neyman was hired. We prevailed on the district attorney to reduce the charges to simple assault and battery, a misdemeanor under G.L. c. 265 section 13A and to further agree to a continuance without a finding (CWOF). All charges will be dismissed in a few months.
