Charges of Domestic Assault and Battery and Strangulation Against Non-Citizen Engineer Dismissed
Our client is a non-citizen in this country pursuant to a work visa. He is an engineer who has every intention of applying for citizenship in the near future. In August of this year he and his wife got into a heated argument that she claims turned physical. She called the police from outside of the marital home claiming that her husband had just beat her and thrown her on the bed while placing his knee against her throat and cutting off her ability to breathe. The police arrived and separated the parties. After interviewing both, the police opted to arrest our client and charge him with strangulation under G.L. c. 265 section 15D, a felony in Massachusetts and domestic assault and battery under to G.L. c. 265 section 13M. In as much as our client is not a citizen any conviction or admission to either of these crimes would likely be fatal to any effort at obtaining citizenship. Our office was hired immediately. Today we succeeded in having all charges dismissed.
