Charges of Domestic Assault and Battery Against Accountant Dismissed
In January of this year police in a coastal Massachusetts town had information about a domestic violence situation involving a husband and wife. The officers met with the wife who claimed that during an argument her husband, our client, struck her several times. This activity supposedly occurred in the presence of the wife’s daughter from a prior relationship. The daughter denied seeing anything. However she did relate that she heard yelling and screaming in an adjacent room. The police arrested our client and charged him with domestic assault and battery. This is a crime under G.L. c. 265 section 13M. Our office was hired. The wife moved out of state and made clear to our office that she did not want to proceed with this case. Accordingly, Attorney Neyman expedited the case and moved for a non-binding bench trial. This type of proceeding must be agreed to by the prosecutor. It facilitates an anticipated result without further delaying the process. Today, the charges were dismissed.
