Charges of Carrying a Firearm Without a License to Carry Against Truck Driver Dismissed
Our client is an independent truck driver who logs over 150,000 miles per year for work. He is from a state that permits its residents to carry firearms without a license to carry. Our client was not aware of Massachusetts laws that strictly require anyone carrying a firearm to have a license to carry. While driving through Massachusetts for work, our client wsa pulled over for speeding. As he believed he was required to do, he removed his gun from the center console and placed it on the passenger’s seat to alert the officer that in fact he had a gun. The officer quickly learned that our client did not have a license to carry a firearm. He was arrested and charged with possession of a firearm under G.L. c. 269 section 10a, a felony in Massachusetts. That crime carries a minimum eighteen months in jail upon a conviction. After some lengthy negotiations we prevailed on the prosecution to agree to dismiss this charge.
