Charges of Assault by Means of a Dangerous Weapon Against Non-Citizen to be Dismissed After Pretrial Probation
Our client is a non-citizen who was getting his Doctorate and working in Massachusetts. In October of last year he was arrested and charged with assault by means of a dangerous weapon. This is a felony under G.L. c. 265 section 15B. Just two weeks ago he hired Attorney Stephen Neyman as his second lawyer. Given that the man had a student visa due to expire later this month, a resolution in short order was necessary. Our office advanced the case for a trial in less than two weeks. Today, we got pretrial probation pursuant to G.L. c. 276 section 87 for our client. The case will be dismissed shortly and our client should not have any problems returning to the country in the future.
