We went into court today and successfully removed the stay away and no contact order. The couple can resume their relationship.</p>

<p>Our client is a graduate student at a prestigious local University. He is working towards his Master’s in computer engineering. In January of this year a fellow student went to the police department complaining that our client had been harassing her relentlessly. The woman claimed that our client was persistent in his efforts to date her. When he was ultimately rejected by her he supposedly began stalking her, sending threatening text, and telephoning her non-stop. The woman provided documentation to the police that purported to support her contentions. Consequently, our client was charged with <a href="https://www.neymanlaw.com/practice-areas/miscellaneous-crimes/stalking-and-criminal-harassment-in-massachusetts/">criminal harassment</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-43a-criminal-harassment-punishment/">G.L. c. 265 Section 43A</a>.  He was also served with a harassment prevention order that day in accordance with <a href="https://www.neymanlaw.com/practice-areas/restraining-orders/">G.L. c. 258E</a>.  Several days later the woman returned to the police station alleging that this man had violated the HPO by texting her additional threatening messages. More charges were filed, specifically a violation of the HPO. As a result, bail was revoked and the man was ordered confined to the local jail for 90 days. Later that day his family contacted attorney Stephen Neyman and hired him to represent the man for both cases. Today, we went into court and convinced the judge to reinstate bail and release our client.</p>

<p>The government alleges that nearly two years ago our client, along with four other people broke into a home, pistol whipped to residents causing one of them hospitalization and a significant injury.  The investigation resulted in our client being charged with <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/home-invasion/">masked armed home invasion</a> and <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault and battery by means of a dangerous weapon</a> causing serious bodily injury. These are crimes in Massachusetts pursuant to G.L. c. 266 Section 14 and <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 Section 15A</a> respectively.  The indictment was issued in December of 2025. As a result the prosecution issued a warrant. Our client was arrested in Florida where he had been living. He was transported to Massachusetts where the District Attorney’s office moved for detention under the <a href="https://www.neymanlaw.com/practice-areas/bail-hearings/">dangerousness </a>statute, G.L. c. 276 section 58A.  After a hearing, the judge agreed with our position and ordered the release of our client. There are no restrictions on him other than to stay away from the named victims and witnesses in this case.</p>

                <content:encoded><![CDATA[ <p>In 1995 our client was arrested and charged with <a href="/practice-areas/drug-crimes/drug-trafficking-in-massachusetts/">trafficking heroin, a class A substance in excess of 100 grams</a>, <a href="/massachusetts-general-laws/massachusetts-g-l-c-94c-32e-trafficking-in-marijuana-cocaine-her/">G.L. c. 94C section 32E</a> and <a href="/practice-areas/drug-crimes/possession-with-intent-to-distribute-drugs-in-massachusetts/">possession with the intent to distribute cocaine, a class B substance</a>, <a href="/massachusetts-general-laws/g-l-c-94c-32-class-a-controlled-substance-offenses-involving-dis/">G.L. c. 94C section 32A</a>. Our office did not represent her at that time. Fearing a conviction and facing a minimum 10 year sentence, our client defaulted and fled to another state where she remained for 27 years. Always living in fear of getting caught she finally decided to come into court and face the charges. She hired our office to represent her.                 <content:encoded><![CDATA[ <p>The defendant is nineteen years old. On August 22, 2022 he was driving a family member’s car. He had several passengers in the car. The police pulled him over for allegedly running through a stop sign. The officer claimed that all of the occupants got out of the vehicle without being asked. One of the officers reported that our client, the driver, permitted him to search the car. The same officer reported that while searching, he observed a firearm in plain view on the floor of the passenger side of the vehicle. Our client and the others were arrested and charged with violating <a href="/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10(a)</a>, <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/">unlawful possession of a firearm</a>. A conviction for this carries a mandatory eighteen month jail sentence. Represented by another lawyer, the defendant was detained under <a href="/practice-areas/bail-hearings/">G.L. c. 276 section 58A</a>, the Massachusetts “dangerousness” law. We were subsequently hired. Our investigation produced a videotape of the officer violating our clients rights by conducting a full, non consensual search of the vehicle and finding the gun tucked under the passenger seat, not in plain view. With this information, we convinced the judge to release our client. </p>

He is facing a mandatory 12 year state prison sentence.
