<p>Our client is an engineer in the greater Boston area.  He also volunteers nights and weekends in the fall at a local farm. His duties there involve security and theft prevention. About a year and a half ago while working at the farm our client was alerted that two women had stolen several items by secreting them into a baby carriage. Our client confronted them about the theft. Both women became extremely aggressive. One of them struck our client with her cell phone in the face several times. She then complained to the local police that he in fact struck her and that she never touched him. A criminal complaint charging him with <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/">assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a> issued. Our office was hired. Today, we were able to get the case dismissed. </p>

<p>Our client is a school bus and Uber driver who lives in a modest home with his wife and four children. In September of last year, our client got into a dispute over ownership of his home. Without his knowledge, the home was listed for sale and a realtor was engaged. The realtor went to show the home. She knocked on the door and entered with a prospective buyer. She was confronted by our client who demanded that she leave the home. She did not. According to the realtor, our client struck her in the head with his fist. He was ultimately charged with <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/">assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a>. Today, Attorney Neyman was able to get the case dismissed. </p>

<p>Our client is a top software sales executive who lives and works on the west coast. In June of this year he was in Massachusetts for business purposes. He went to a well-known bar/restaurant after a long day of work. There, he ended up drinking much more than he is accustomed to. He started to argue with patrons of the establishment and he was asked to leave. For some time he did not. Subsequently, he went outside and started an argument with a woman who identified as gay. The argument became physical and he struck the woman. The police were called. The man was arrested and charged with assault and battery to intimidate, G.L. c. 265 section 39, trespassing, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-266-120-trespass/">G.L. c. 266 section 120</a> and disorderly person, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">G.L. c. 272 section 53</a>. Our office succeeded in having the case <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continued without a finding</a> for a few months (CWOF). All charges will soon be dismissed. </p>

<p>The victim in this case is an 87 year old man in the care of an assisted living facility. Several months ago, his former wife entered the nursing home for a visit. According to eyewitness reports, the visit became hostile. The victim started to yell out for assistance. Our client supposedly struck him in the face and mouth during the incident. Our client was arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/">assault and battery on a person over the age of 60</a>. This is a felony in Massachusetts under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13-k-assault-and-battery-upon-an-elderly/">G.L.c. 265 section 13K</a>. Attorney Neyman was hired. Today, we resolved the case with <a href="https://www.neymanlaw.com/legal-resources/pre-trial-probation/">pretrial probation</a> under G.L. c. 276 section 87. The case will be dismissed outright in a few months.</p>

Unfortunately, his actions and not the actions of the woman were witnessed by an off duty police officer. The man was charged with <a href="/practice-areas/assault-and-battery/">assault and battery</a> in violation of <a href="/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a>. Our office was hired. Today, we convinced a judge to continue the matter continued without a finding (<a href="/practice-areas/massachusetts-continuance-without-a-finding/">CWOF</a>) for 60 days. At that time all charges will be dismissed. </p>

Rather than following the app he drove around in circles for 38 minutes. The passenger demanded he stop the car. He exited and was met by police officers within seconds. The driver claimed that after a dispute our client kicked him and ripped his headset off and destroyed the equipment. An application for a criminal complaint charging <a href="/practice-areas/assault-and-battery/">assault and battery</a> under <a href="/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a> and <a href="/practice-areas/violent-crimes/malicious-destruction-of-property/">vandalism</a> under <a href="/massachusetts-general-laws/massachusetts-g-l-c-266-126a-vandalism/">G.L. c. 266 section 126A</a> followed. Attorney Stephen Neyman was hired to defend the man. At a clerk magistrate we convinced the magistrate not to issue the criminal complaint. The matter will be held for 6 months and dismissed provided our client does not commit any crimes. </p>

He was subdued, arrested and charged with <a href="/practice-areas/assault-and-battery/">assault and battery</a> on a police officer,<a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13d-assault-and-battery-on-a-police-offi/"> G.L. c. 265 section 13D</a>, <a href="/practice-areas/resisting-arrest/">resisting arrest</a>, G.L. c. 268 section 32B and disorderly person, G.L. c. 272 section 53. Today, Attorney Neyman was able to get pretrial probation for our client under <a href="/legal-resources/pre-trial-probation/">G.L. c. 276 section 87</a>. All charges will be dismissed in a few months.</p>

Fearing he was going to report these multiple incidents to the police, she took a preemptive strike and called the police on him accusing him of threatening to commit a crime, specifically <a href="/practice-areas/assault-and-battery/">assault and battery</a> under <a href="/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a>. The threats charge violates <a href="/massachusetts-general-laws/massachusetts-g-l-c-275-2-threat-to-commit-a-crime/">G.L. c. 275 section 2</a>. For some reason, the defendant missed a clerk magistrate hearing and a criminal complaint issued against him. That is when we were hired. When they got to the location they were told by the defendant’s mother that he was undergoing a mental health episode. The officers confronted the man to try to help. The man lunged at one of the officer’s holsters trying to get his gun. The other officers tried to subdue the defendant. He responded by hitting all four of the officers at the home. He was charged with <a href="/practice-areas/assault-and-battery/assault-and-battery-on-a-police-officer/">assault and battery on a police officer</a> prohibited by <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13d-assault-and-battery-on-a-police-offi/">G.L. c. 265 section 13D</a>. Today was the arraignment date. We were able to negotiate <a href="/legal-resources/pre-trial-probation/">pretrial probation</a> under G.L. c. 276 section 87, unsupervised. All charges will be dismissed soon. </p>

This resulted in our client being injured. Consequently, and as is so often done, the police claimed that our client hit them. As a result, charges of <a href="/practice-areas/domestic-violence/">domestic assault and battery</a> <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a> and <a href="/practice-areas/assault-and-battery/assault-and-battery-on-a-police-officer/">assault and battery on a police officer</a> <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13d-assault-and-battery-on-a-police-offi/">G.L. c. 265 section 13D</a> and <a href="/practice-areas/resisting-arrest/">resisting arrest</a> G.L. c. 268 section 32B issued. The resisting arrest and domestic assault and battery charges were dismissed. The assault and battery on a police officer charges were generally continued for two weeks. This means that those charges will be dismissed in two weeks. </p>
