<p>Our client is a top software sales executive who lives and works on the west coast. In June of this year he was in Massachusetts for business purposes. He went to a well-known bar/restaurant after a long day of work. There, he ended up drinking much more than he is accustomed to. He started to argue with patrons of the establishment and he was asked to leave. For some time he did not. Subsequently, he went outside and started an argument with a woman who identified as gay. The argument became physical and he struck the woman. The police were called. The man was arrested and charged with assault and battery to intimidate, G.L. c. 265 section 39, trespassing, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-266-120-trespass/">G.L. c. 266 section 120</a> and disorderly person, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">G.L. c. 272 section 53</a>. Our office succeeded in having the case <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continued without a finding</a> for a few months (CWOF). All charges will soon be dismissed. </p>

<p>On Halloween night of this year our clients, husband and wife, were home with their younger children. One child, high school aged, was permitted to have some friends at the home. Around 7:30 our clients noticed that one of the guests was visibly intoxicated. They immediately called the police and the parents of all underaged people at the home. The police arrived and observed what they called a “significant” amount of alcohol in the basement.  Notwithstanding the fact that our clients had done everything the right way, the police department applied for a criminal complaint against our clients asking for charges of providing alcohol to a minor to be issued. This is a crime under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-138-34c-minors-operation-of-motor-vehicle-co/">G.L. c. 138 section 34</a>. Attorney Neyman was hired. Today, after a <a href="https://www.neymanlaw.com/practice-areas/clerk-s-hearings/">clerk magistrate hearing</a>, the complaint did not issue.</p>

<p>Our client is a security consultant who has been in that industry for nearly 30 years. Several months ago he responded to an internet listing for sexual services in exchange for money. The pre-arranged meeting place was a hotel. When the man entered the hotel he went to the room where he was to receive services. He was met by police officers who immediately arrested him and charged him with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">solicting sex for a fee</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53A</a>. <p>Our client is the owner and CEO of a multinational fiber optics Corporation. Last winter he was having  a major remodeling construction job at his suburban Boston home. The general contractor was an extremely unsavory businessman who attempted to cheat our client out of several hundred thousand dollars. When our client recognized what was going on he terminated the contract with the man.  The general contractor returned to the property several days later with several men. All of them threatened my client and tried to extort more money from him. When our client refused to accede to their demands the men  threatened our client with bodily harm. To diffuse the situation the client took out a licensed firearm, pointed it towards the men and threatened to kill them. He was ultimately arrested and charged with several counts of <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault by means of a dangerous weapon</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15B</a>. Attorney Neyman was hired. Today, we were able to get our client a <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continuance without a finding</a>. All charges will be dismissed in a few months. </p>

<p>Our client is an extremely well educated mother of three children. She and her ex-husband have been battling in the Probate Court for several years now. At every stage of the Probate Court process our client has enjoyed great success.  Her ex-husband cannot accept defeat. In as much as he has been unable to prevail in the Probate Court he started strategically applying for restraining orders and applying for criminal complaints.  After successfully obtaining a restraining order he  met with local police and detailed several violations alleged to have been committed by our client. An overly aggressive and unusually invested police officer assisted him and brought an application for a complaint against our client charging a <a href="https://www.neymanlaw.com/practice-areas/restraining-orders/">violation of a 209a restraining order</a> under G.L. c. 209A section 7 and <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-43a-criminal-harassment-punishment/">criminal harassment</a> under G.L. c. 265 section 43A. The man had an excellent lawyer appear on his behalf at the <a href="https://www.neymanlaw.com/practice-areas/clerk-s-hearings/">clerk magistrate hearing</a>. Our office successfully argued that the factual basis for the issuance of a criminal complaint was non-existent. The clerk magistrate agreed with us and he did not find probable cause. The complaints did not issue. </p>

<p>Our client is an electrician working on both residential and commercial jobs throughout the greater Boston area.  several months ago he and some friends from work stopped at a bar after a long day on a large project. Several hours later when our client was driving away a police officer observed him operating very erratically, nearly striking cars in the opposite lane of travel. A motor vehicle stop was effectuated. Our client submitted to field sobriety test. These were captured on body worn cameras. Our client then submitted to a breathalyzer test where he blew over three times the legal limit. He was charged with OUI in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-90-24-1-operating-under-the-influence/">G.L. c. 90 section 24</a>. Our office was hired to represent him. Notwithstanding the severity of the allegations we were able to convince a judge to <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continue the case without a finding</a> and impose the typical first offender 24D program. </p>

Unbeknownst to her  Her ex-husband had provided police with an edited video suggesting that her police report was a lie. <p>Our client is a college professor who would lose his job if convicted of the two crimes for which he was charged, one of which is a felony.  In July of this year he and his older brother got into an argument over the care of their father whose health was failing. The brother claimed that the argument became physical and that our client hit him. In as much as the older brother is over the age of 60 the crime for which our client was charged is a felony, <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/aggravated-assault-and-battery/">assault and battery on an elderly person</a>, a crime under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13-k-assault-and-battery-upon-an-elderly/">G.L. c. 265 section 13K</a>.  At the time of the incident the brother also took out a restraining order against our client under G.L. c. 209A.  Just days later the brother claimed that our client had violated the restraining order by encroaching on the hundred foot exclusion zone established by the order.  Consequently, another charge, a <a href="https://www.neymanlaw.com/practice-areas/restraining-orders/">violation of the restraining order</a> under G.L. c. 209A section 7 issued against our client. Attorney Neyman was hired. Today, we were able to get our client <a href="https://www.neymanlaw.com/legal-resources/pre-trial-probation/">pretrial probation</a> under G.L. c. 276 section 87. All charges will be dismissed in just a few months. </p>

<p>In June of this year police were called to a very popular Beach for a report of a man walking around naked and seemingly very confused. He was asking people if he could use their cell phones. He was making no sense and it was obvious that he was having some sort of a crisis. The responding officers tried to calm him down to no avail. They were able to contact his wife who came to the beach with fresh clothes so that our client could get dressed. He was arrested and charged with <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">disorderly conduct</a> in violation of G.L. c. 272 section 53 and <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a>, a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-272-16-open-and-gross-lewdness-and-lascivious-behavior/">G.L. c. 272 section 16</a>.  Our office had our client evaluated for a risk assessment and to identify any potential mental health issues or any identifiable sexual  predatory concerns. Our forensic psychologist quickly ascertained that our client was having a reaction to mixing diet drugs with edibles. The combination caused confusion and aberration of behavior. The evaluation and Report was significant enough to convince the assistant district attorney to agree to a resolution of pretrial probation pursuant to <a href="https://www.neymanlaw.com/legal-resources/pre-trial-probation/">G.L. c. 276 section 87</a>. All charges will be dismissed in 6 months. </p>

Last year he was faced with some serious allegations regarding <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-child-under-fourteen/">inappropriate touching of a girl under the age of 14</a>, a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13b-indecent-assault-and-battery-on-a-ch/">G.L. c. 265 section 13B</a>.  We succeeded in having the government dismiss the sexual assault allegation and continue a <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/">simple assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a>  without a finding (<a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">CWOF</a>). Our client asked us to come in to court and terminate the probationary portion of his sentence early. Today, we prevailed upon the court to do just that. The probation has terminated in the case has been dismissed.</p>

<p>In November of 2024 police in a suburban Boston city responded to a call from a man breaking into a home rented to another person. When they arrived they observed a hole in the sheetrock of the kitchen large enough for a human body to fit through. The caller told the police that our client, a bus driver, had sawed his way through the wall from the basement. Our client was present and admitted to doing so. However, he claimed that he was the rightful owner of the home and that the alleged victim was occupying the property unlawfully. The case was initially prosecuted as an <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/aggravated-or-armed-burglary/">unarmed home invasion</a> under <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/aggravated-or-armed-burglary/">G.L. c. 266 section 16</a>. It was later reduced to breaking and entering in the nighttime with the intent to commit a felony also in violation of G.L. c. 266 section 15. Attorney Neyman was hired and today all charges against our client were dismissed. </p>

In July of this year police were called after a woman claimed to see a man outside of his car wearing nothing but a thong and manipulating his genitalia while looking in her direction. The officers who responded questioned the man about the alleged sexual activities. He denied any overt sexualized behavior but he did admit to undressing down to the undergarments identified by the female collar. The officers took the man’s information and ultimately summoned him for an arraignment charging him with a felony, <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-272-16-open-and-gross-lewdness-and-lascivious-behavior/">G.L. c. 272 section 16</a>. Attorney Neyman was hired.  We had our client submit to an evaluation conducted by our forensic psychologist who determined that he is not a public safety risk nor does he present with any concerning sexual  mental health issues. That evaluation coupled with great character references and an extremely impressive work history satisfied the assistant district attorney that <a href="https://www.neymanlaw.com/legal-resources/pre-trial-probation/">pretrial probation</a> under G.L. c. 276 section 87 is the appropriate disposition. This case will be dismissed in a few months. </p>

<p>At the time of this incident our client was a college student finishing his senior year. He had a well-documented mental health history that he had managed quite well for several years. As commencement neared the man took an opportunity to celebrate with a group of his classmates and a well known nightclub. He ingested several different types of alcohol in a short amount of time.  He had a bad reaction to the combination of alcohol and mental health medication. Consequently, he became unruly and was escorted out of the establishment. In the process, he struck several bouncers. The police were called and they tried to subdue him. In the process our clients struck them as well. He was charged with several counts of <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/">assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a>, disturbing the peace and <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">disorderly person</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">G.L. c. 272 section 53</a>, one count of trespass <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-266-120-trespass/">G.L. c. 266 section 120</a>, two counts of <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/assault-and-battery-on-a-police-officer/">assault and battery on a police officer</a> G.L. c. 265 section 13D and <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault and battery by means of a dangerous weapon</a>, his shod foot, a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15A</a>. He has been prescribed various medications to address his illness. At the time of this alleged incident none of the medications appear to be working. In February of this year the prosecution alleged that our client was driving naked through a wealthy Boston suburb. A young woman observed him masturbating while he was driving. She memorized his license plate and contacted the police. The police were able to obtain registry of motor vehicle information including a driver’s license photo and ask the woman to participate in a photographic array. She did. She identified our client as the perpetrator. He was ultimately arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a> and violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-272-16-open-and-gross-lewdness-and-lascivious-behavior/">G.L. c. 272 section 16</a>. This is a felony in Massachusetts. Attorney Neyman was hired. Today, we were able to convince a judge to <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continue the case without a finding</a> (CWOF) for a short period of time. We  did so by engaging a forensic psychologist who was able to identify the trigger for our clients issues. She referred him to a psychiatrist who prescribed appropriate medications and his urges and behavior have been appropriately modified.</p>

In April of this year police were called to his home for a complaint of a <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/">domestic assault and battery</a> and strangulation.  The facts of the case were dubious in that the alleged victim in the case recanted on several occasions and showed no visible signs of injury when the police investigated her complaint. Unfortunately she made a 911 call that a judge deemed partially admissible or the case to go to trial. The <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/strangulation-or-suffocation/">strangulation </a>count is a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-15d-strangulation-or-suffocation/">G.L. c. 265 section 15D</a>. We were able to get that count dismissed. The remaining count, domestic assault and battery under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a> was continued without a finding (CWOF) and will be dismissed in 60 days. </p>

In May of this year he responded to an advertisement online to a woman claiming to provide sexual services in exchange for money. A meeting location was provided to our client along with a cell number. He was told to drive to that address. He was further advised that when he arrived he was to text the number and meet up with the woman to pay her for sexual services. He did this only to find out that the woman was an undercover police officer participating in a wide scale sting operation throughout Eastern Massachusetts. The incident was captured on audio and text messages confirmed the intentions of our client. He was charged with soliciting <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sex for a fee</a> which is a crime under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53</a>. Attorney Neyman was hired. He filed a motion for pre-arraignment diversion under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-276a-pretrial-diversion/">G.L. c. 276A</a>. <p>Our client is a 68-year-old construction worker who owns a very successful lucrative Construction Company. In June of this year he was driving through an area of a Massachusetts city well known for a concentration of prostitutes. He pulled his car to the side of the street and parked. Within minutes a woman approached his window and asked him if he was interested in having a quote “date”. The man said yes and a fee was negotiated for oral sex. Unbeknownst to the man, the woman was an undercover police officer. He was summoned to court charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/">sex for a fee</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53</a>.  Notwithstanding his age, our client had a relatively significant criminal past. Nevertheless, the judge agreed to <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continue the case without a finding</a> (CWOF) for 60 days. All charges will be dismissed provided he remains free from criminal legal trouble during that time period. </p>
