Rowley OUI

Rowley is a town in Essex County, Massachusetts with a population of only 5,500 in its 20.6 square miles. Rowley is bordered by Newbury, Georgetown, Boxford, and Ipswich. Originally settled by about 20 families as a plantation, the town was incorporated in 1639 and named for Rowley, East Riding of Yorkshire.

Breath tests, which measure breath alcohol levels, can raise several problems because everyone has unique biological characteristics while breathalyzers are based on what is average.

Persons can refuse to take breathalyzers, and this is often a good idea, even though it results in automatic license suspension for a period that will depend upon the number of prior offenses, if any. If one refuses a breathalyzer for a first offense, then the suspension period will be 180 days. The refusal will be inadmissible in a criminal proceeding. Evidence of the refusal is also inadmissible to show attitude or behavior in the refusal.

Field Sobriety Tests

Field sobriety tests commonly include walk and turn testing, the one leg stand, and horizontal gaze testing. Often times, administration of field sobriety tests is improper or the circumstances of the testing render the tests unfair.
