<p>The defendant owned a large company that developed cable network systems for large corporations and major cities. He was an avid gun collector. A couple of years ago he brandished a lawfully owned firearm to protect himself during a dispute where he was seriously physically threatened. Notwithstanding the lawfulness of his conduct local police revoked his license to carry. In doing so they went to his home and confiscated his firearms. When the police inventoried the weapons they observed several assault style guns and a good number of high capacity feeding devices. These weapons are illegal to possess in Massachusetts even though our client had a valid license to carry. He was charged with a dozen counts of <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/unlawful-possession-of-an-assault-weapon-or-large-capacity-feedi/">unlawful possession of assault weapons</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-140-131m-unlawful-possession-of-an-assault-w/">G.L. c. 140 section 131</a>. These are felonies in Massachusetts that carry a mandatory minimum prison sentence. Attorney Neyman was hired to defend him. We were able to show that the government was unable to prove that the weapons had been purchased after the date making such weapon possession unlawful. As a result, all charges were dismissed. </p>

He was facing a mandatory minimum 18 month sentence and likely more for additional charges of <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage</a>, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a> and a loaded firearm under G.L. c. 269 section 10(n). The <a href="https://www.neymanlaw.com/practice-areas/search-seizure/">successful motion to suppress </a>prevented the district attorney from continuing its prosecution of our client. As such, all charges were dismissed today. </p>

<p>Last summer our client, a former Marine and combat veteran was pulled over for a moving violation. The police quickly learned that his license had been suspended and that he was in violation of <a href="https://www.neymanlaw.com/practice-areas/motor-vehicle-offenses/operating-after-suspension-or-revocation-of-license/">G.L. c. 90 section 23</a>, an arrestable offense in Massachusetts. During the arrest the police located a loaded firearm for which our client did not have a license. He was charged with <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10(a)</a> and G.L. c. 269 section 10(n) for those charges. The 10(a) carries a mandatory 18 month house of correction sentence upon conviction. Our client was also charged with <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a> under G.L. c. 140 section 131L and possession of ammunition under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-269-10-h-1-unlawfully-possessing-a-firearm-o/">G.L. c. 269 section 10(h)</a>. Our office was able to get the mandatory charges dismissed. Our client then got a <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continuance without a finding</a> (CWOF) for the unlawful possession of ammunition charge. All charges will be dismissed in a few months. </p>

<p>Our client owns a chain of restaurants throughout the Northeast. In January of this year he got into an altercation with two individuals near his home. The two individuals were insulting our client about his ethnicity. Our client verbally defended himself and did everything he could to avoid physical contact with these people. Nevertheless, these individuals became increasingly violent and threatened our client. Consequently, and in response to the physical attack, our client brandished a gun in self-defense. The two assailants fled and contacted the police. Both of these individuals provided false narrative to the police resulting in our client being charged with two counts of <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault and battery by means of a dangerous weapon</a>, <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15B</a> and <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-275-2-threat-to-commit-a-crime/">threatening to commit a crime, G.L. c. 275 section 2</a>. Attorney Neyman was hired. Today, all charges were dismissed. </p>

<p>Our client is an independent truck driver who logs over 150,000 miles per year for work. He is from a state that permits its residents to carry firearms without a license to carry. Our client was not aware of Massachusetts laws that strictly require anyone carrying a firearm to have a license to carry. While driving through Massachusetts for work, our client wsa pulled over for speeding. As he believed he was required to do, he removed his gun from the center console and placed it on the passenger’s seat to alert the officer that in fact he had a gun. The officer quickly learned that our client did not have a license to carry a firearm. He was arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/">possession of a firearm</a> under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10a</a>, a felony in Massachusetts. That crime carries a minimum eighteen months in jail upon a conviction. After some lengthy negotiations we prevailed on the prosecution to agree to dismiss this charge. </p>

<p>Last summer the defendant was driving in a suburban Boston city. According to the police report and the officer who testified at the hearing, the defendant was driving on the wrong side of the road. He nearly hit the officer head on. He nearly hit several other vehicles and pedestrians in the area. In response, the officer made a U-Turn and stopped the vehicle. For officer safety purposes the defendant was removed from the car. The officer then searched a fanny pack on the passenger seat. In the pack he found a gun. The defendant was charged with carrying a loaded firearm under G.L. c. 269 section 10(n), <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/">carrying a firearm without a license to carry</a> under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269(a)</a>, possession of ammunition under G.L. c. 269 section 10(h) and possession of a large capacity feeding device under G.L. c. 269 section 10(m) <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a> under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a> and negligent operation of a motor vehicle under G.L. c. 90 section 24. The defendant hired Attorney Neyman right away. We obtained a Court Order under Rule 17 permitting access to city street cameras. We also got a court order to obtain parking garage security footage. The videos made clear that the police officer was not telling the truth at the hearing. The defendant was not operating on the wrong side of the road, there was no near accident, there were no pedestrians in the area and the defendant was not operating in a manner that would endanger the public. The judge hearing the motion allowed the motion and suppressed the evidence seized as a result of the unlawful search, i.e. the guns. </p>

<p>Our client is a social worker with a bachelors from a top university. He has two masters degrees as well. He is a committed social worker with several decades of service. In October of last year he was going through a contentious divorce with his wife. The two were separated and our client was awarded custody of the couple’s children. The wife came to his house and became violent. He subsequently successfully applied for a restraining order. The police went to serve the wife. When they did she alerted them to several firearms in her home. Although our client had a license to carry LTC it had expired. The officers located the firearms, some ammunition and observed the guns to be stored improperly. Our client was charged with 11 counts including <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/">unlawful possession of a firearm</a> in violation of G.L. c. 269 section 10(h), <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-269-10-h-1-unlawfully-possessing-a-firearm-o/">unlawful possession of ammunition</a> in violation of the same statute and <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a>. Today, all charges were continued without a finding. After a short probationary period all charges will be dismissed. </p>

<p>Our client is a very successful civil engineer credited for the design and rehabilitation of multiple bridges throughout the northeast. He had a license to carry a firearm (LTC) at the time of this incident. Back in August of last year he had been drinking and was riding his bicycle on a very busy urban street. An Uber carrying some aggressive passengers nearly hit him at an intersection. The occupants then threw water on our client using their water bottles. In response, our client brandished his lawfully owned firearm and the Uber left the scene. The police were called and our client was subsequently identified and arrested. He was charged with <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault by means of a dangerous weapon</a>, a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15B</a> and <a href="https://www.neymanlaw.com/practice-areas/carrying-firearms-possession-of-a-firearm/">carrying a firearm while intoxicated</a>, a misdemeanor under G.L. c. 269 section 10H. Attorney Neyman was hired. Today, we were able to get our client pretrial probation under <a href="https://www.neymanlaw.com/legal-resources/pre-trial-probation/">G.L. c. 276 section 87</a>. All charges will be dismissed soon. </p>

                <content:encoded><![CDATA[ <p>This past St. Patrick’s Day, our client was in Massachusetts visiting his girlfriend. He was carrying a firearm. He was licensed to do so in Connecticut and did not realize that he needed an LTC to carry in Massachusetts. While in the girlfriend’s apartment a “friend” saw the gun and asked to hold it. Our client refused to permit the man to do so. An argument followed and the man left the apartment. Several minutes later the police arrived. Apparently, the man who was slighted by our client called to report the presence of a firearm. The police inquired about the gun. Our client cooperated with the police and showed them the gun. When they learned that he did not have an LTC he was arrested and charged with violation of <a href="/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10(a)</a>, a felony in Massachusetts mandating 18 months in jail. Attorney Neyman was immediately hired. Today, we convinced the district attorney’s office to dismiss the charges. </p>

In August of 2022 he was at a bar with friends when a fight broke out between his group and another group. The fight continued out in the street when all parties left the bar. The police arrived and all parties fled. A few were caught by the responding officers. The apprehended people told the officers that our client had pulled a gun on them and fled the scene in a car. The officers located the car, registered to our client. They observed a gun in the car in plain view. The car was impounded and searched. The gun was registered to our client. He was charged with <a href="/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault by means of a dangerous weapon</a> under <a href="/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15B</a>. This is a felony in Massachusetts. He was also charged with <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a> under <a href="/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a>. Attorney Neyman was able to get the felony dismissed. The improper storage charge was <a href="/practice-areas/massachusetts-continuance-without-a-finding/">continued without a finding</a> (CWOF). That charged will be dismissed in a few months. </p>

Our client lives in a constitutional carry state and is lawfully permitted to carry that weapon in that state but not in Massachusetts. Our client did everything the right way. He reported that weapon stolen and cooperated with the police including testifying for the district attorney’s office at the other man’s trial. Nevertheless, our client was charged with <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/">carrying a firearm</a> <a href="/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10(a)</a> and <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a> <a href="/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a>. After nearly a year of negotiation, today, Attorney Neyman was able to get the charges dismissed. </p>

The defendant was charged with <a href="/practice-areas/motor-vehicle-offenses/operating-without-being-licensed/">unlicensed operation of a motor vehicle</a> G.L. c. 90 section 10, possession of ammunition without a license <a href="/massachusetts-general-laws/massachusetts-g-l-c-269-10-h-1-unlawfully-possessing-a-firearm-o/">G.L. c. 269 section 10(h)</a> and <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/">carrying a firearm</a> in violation of <a href="/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10(a)</a>. The case was scheduled for trial today. The district attorney admitted to the inability to proceed with the case following the successful constitutional challenge. Several weeks ago he engaged men to detail his car and his girlfriend’s car. The detailers went to his home and were unable to access water so it was agreed that they could take the cars down the street to do the detailing close by. The defendant legally owned a gun that was in the console of the car. Without our client’s consent, the detailers took both cars and started drag racing. Both were stopped. The police located the gun in our client’s car. A summons for a <a href="/practice-areas/clerk-s-hearings/">clerk magistrate hearing</a> charging <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a> under <a href="/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a> was sent to our client. Today, Attorney Neyman persuaded the clerk magistrate hearing and the police sergeant not to issue the complaint. </p>

He was asked to exit his car, put through field sobriety tests and pat frisked. He was found in possession of a firearm for which he had a license to carry. He was charged with <a href="/practice-areas/dui-defense/">OUI</a>, <a href="/massachusetts-general-laws/massachusetts-g-l-c-90-24-1-operating-under-the-influence/">G.L. c. 90 section 24</a> and possession a firearm while intoxicated. During the booking process officers learned that our client had several assault weapons, large capacity feeding devices and banned firearms. Consequently he was charged with 16 additional gun crimes including unlawful possession of an assault weapon, <a href="/massachusetts-general-laws/massachusetts-g-l-c-140-131m-unlawful-possession-of-an-assault-w/">G.L. c. 140 section 131M</a>, possession large capacity firearms, G.L. c. 269 section 10(m) and <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a>, <a href="/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a>. After over a year of litigation, today, our office was able to get all gun charged dismissed. </p>

The officer looked to see if someone was in the car. As he did so the defendant left the driver’s side rear door opened and the defendant exited the car. He smelled like he had been smoking marijuana. The defendant presented the police officer with a valid driver’s license. The officer asked if there was any contraband in the vehicle. The defendant said there was marijuana in the vehicle. The officer searched the car and found marijuana, a scale and a gun under the driver’s seat. The defendant was arrested and charged with carrying a loaded firearm without a license, G.L. c. 269 section 10(n), <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/unlawful-possession-of-an-assault-weapon-or-large-capacity-feedi/">possession of a large capacity firearm</a>, G.L. c. 269 section 10(m), <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a>, G.L. c. 140 section 131L, <a href="/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">carrying a firearm without a license to carry (LTC)</a>, G.L. c. 269 section 10(a), possession of ammunition, <a href="/practice-areas/drug-crimes/possession-with-intent-to-distribute-drugs-in-massachusetts/">G.L. c. 269 section 10(h)</a> and <a href="/practice-areas/drug-crimes/possession-with-intent-to-distribute-drugs-in-massachusetts/">possession with the intent to distribute a class D drug</a>, <a href="/massachusetts-general-laws/g-l-c-94c-32-class-a-controlled-substance-offenses-involving-dis/">G.L. c. 94 section 32C</a>.                 <content:encoded><![CDATA[ <p>About two and a half years ago a fight broke out at a bar in a large Massachusetts city. The fight ended when shots were fired. Video footage gained from the crime scene showed two men accompanied by our client enter and exit the bar. The men were identified as possessing firearms and one of them was identified as the shooter. Social media apps were accessed through informants and a search warrant as well. These convincingly linked our client to these men at the time when they possessed the weapons. They further showed our client driving these individuals from the crime scene. Accordingly, our client was charged with being an <a href="/practice-areas/miscellaneous-crimes/accessory-after-the-fact/">accessory after the fact</a> under G.L. c. 274 section 4, a felony in Massachusetts. We succeeded in getting the judge to <a href="/practice-areas/massachusetts-continuance-without-a-finding/">continue the case without a finding</a> (CWOF). After a successful completion of a period of probation the case will be dismissed and can be sealed immediately. </p>

                <content:encoded><![CDATA[ <p>Last month we succeeded in getting a judge to suppress what she agreed was an unlawful search and seizure in relation to a gun case. Our client, a nurse had been charged with unlawful possession of ammunition under <a href="/massachusetts-general-laws/massachusetts-g-l-c-269-10-h-1-unlawfully-possessing-a-firearm-o/">G.L. c. 269 section 10(h)</a>, <a href="/practice-areas/carrying-firearms-possession-of-a-firearm/improper-storage-of-a-firearm/">improper storage of a firearm</a>, <a href="/massachusetts-general-laws/massachusetts-g-l-c-140-131l-improper-storage-of-a-firearm/">G.L. c. 140 section 131L</a> and possession of a firearm in violation of <a href="/massachusetts-general-laws/g-l-c-269-10a-carrying-a-firearm-without-a-license/">G.L. c. 269 section 10(a)</a>. The district attorney’s office refused to appeal the ruling and today the case was formally dismissed. </p>
