<p>Our client is a software engineer working at the same company for over 30 years. He has a remarkable work history. Last year he was accused of assaulting a young female employee by grabbing her buttocks and breast while at the workplace. After the assault the young woman allegedly hid in a bathroom where she called her mother to report the assault. Her mother arrived and confronted our client. He denied the allegations. The police became involved and our client was arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-person-aged-fourteen-or-older/">indecent assault and battery</a>, a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13h-indecent-assault-and-battery-upon-a-person-fourtee/">G.L. c. 265 section 13H</a>. A conviction for this offense would require sex offender registration. Our office had our client evaluated by a well respected forensic psychologist who concluded that our client posed no risk to the public. These efforts resulted in our client getting the case continued without a finding (CWOF). All charged will be dismissed in a few months. </p>

<p>Our client is a security consultant who has been in that industry for nearly 30 years. Several months ago he responded to an internet listing for sexual services in exchange for money. The pre-arranged meeting place was a hotel. When the man entered the hotel he went to the room where he was to receive services. He was met by police officers who immediately arrested him and charged him with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">solicting sex for a fee</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53A</a>. Attorney Neyman was hired. Today, the case was <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continued without a finding for 10 days</a>. <p>Our client is a professor at a well-known University. He has recently been suffering from mental health issues involving depression. He has been prescribed various medications to address his illness. At the time of this alleged incident none of the medications appear to be working. In February of this year the prosecution alleged that our client was driving naked through a wealthy Boston suburb. A young woman observed him masturbating while he was driving. She memorized his license plate and contacted the police. The police were able to obtain registry of motor vehicle information including a driver’s license photo and ask the woman to participate in a photographic array. She did. She identified our client as the perpetrator. He was ultimately arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a> and violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-272-16-open-and-gross-lewdness-and-lascivious-behavior/">G.L. c. 272 section 16</a>. This is a felony in Massachusetts. Attorney Neyman was hired. Today, we were able to convince a judge to <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continue the case without a finding</a> (CWOF) for a short period of time. We  did so by engaging a forensic psychologist who was able to identify the trigger for our clients issues. She referred him to a psychiatrist who prescribed appropriate medications and his urges and behavior have been appropriately modified.</p>

The judge agreed to our <a href="https://www.neymanlaw.com/practice-areas/pre-trial-diversion/">pre-arraignment diversion</a> request under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-276a-pretrial-diversion/">G.L. c. 276A</a>.  Our client is to take and complete a prostitution awareness course. Once this is completed the case will be dismissed.</p>

In February and March of this year he was observed displaying his genitalia through an open window in his apartment. The target of his actions were local female construction workers who had been working in the area for several weeks. In February when they observe this behavior they wrote it off to either aberrational or accidental conduct. Few weeks later when this happened again they realized, based on his deliberate actions that his behavior was directed towards them. The police were called and our client was ultimately arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-272-16-open-and-gross-lewdness-and-lascivious-behavior/">G.L. c. 272 section 16</a>. Today, our office was able to get two of the counts dismissed. The officers approached the car and observed the man sitting in the driver’s seat without a shirt or pants on. The person making the 911 call identified the individual and graphically described the act. Charges of <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a> under G.L. c. 272 section 16, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">disorderly conduct under G.L. c. 272 section 53 </a>and <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-266-120-trespass/">trespassing under G.L. c. 266 section 120</a> were filed. Attorney Stephen Neyman was hired to represent the man. Today, we got the trespass and disorderly person charges dismissed. Our client was given <a href="https://www.neymanlaw.com/legal-resources/pre-trial-probation/">pretrial probation </a>pursuant to G.L. c. 276 section 87 for the open and gross charge. <p>Our client is a software engineer working in Massachusetts under a work visa. A few months ago he responded to a listing on the internet for sexual services for a fee. The listing was in fact a sting operation being run by a Massachusetts human trafficking task force. Our client agreed to meet the purported prostitute at a designated location. When he did he was surprised to find out that the prostitute was actually an undercover police officer. Our client was summonsed for  and arraignment charging him with soliciting a prostitute also known as sex for a fee in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53A</a>. Attorney Neyman was hired.  We had our client entering and complete a prostitution awareness course online. That, coupled with character references, academic accolades and a successful employment history or enough to convince the District Attorney’s office to agree to dismiss the case prior to arraignment. </p>

<p>Our client is a horticultural executive who is well renowned in his field. It is alleged that last Easter he was sitting in a state forest with his pants down to his ankles masturbating. He noticed a woman watching him and he waived at her while continuing the act. The woman called the police who eventually identified him after getting his license plates and registry of motor vehicle photo. He was summonsed to court and charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross lewdness</a>, a felony in Massachusetts in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-272-16-open-and-gross-lewdness-and-lascivious-behavior/">G.L. c. 272 section 16</a>. We negotiated a reduction of the charge to <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/lewd-wanton-and-lascivious-acts/">indecent exposure</a> under G.L. c. 272 section 53 and had the case <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continued without a finding</a> (CWOF). All charges will be dismissed in a few months. </p>

<p>Our client is an engineer who is married and has teenage children. Last summer he was at an amusement park at a beach walking through an arcade. It was alleged that while in there, he pinched the buttocks of a 15 year old girl who had bent down to pick up some coins she had dropped. Witnesses in the area identified this man as being near the girl in the arcade and quickly running out after the incident. Police located him, arrested him and charged him with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-person-aged-fourteen-or-older/">indecent assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13h-indecent-assault-and-battery-upon-a-person-fourtee/">G.L. c. 265 section 13H</a>, a felony in Massachusetts. A conviction of this crime requires sex offender registration. Attorney Neyman was hired. We prevailed on the district attorney to reduce the charges to simple <a href="https://www.neymanlaw.com/practice-areas/assault-and-battery/">assault and battery</a>, a misdemeanor under <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a> and to further agree to a <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continuance without a finding</a> (CWOF). All charges will be dismissed in a few months. </p>

<p>Last fall a well known builder was at a sporting event. He was intoxicated, loud, boisterous and aggressive. The women did not know the man. They became extremely upset. The officer who witnessed the incidents stopped the man and arrested him. He was charged with two counts of <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-person-aged-fourteen-or-older/">indecent assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/g-l-c-265-13h-indecent-assault-and-battery-upon-a-person-fourtee/">G.L. c. 265 section 13H</a>. That is a felony in Massachusetts. <p>Our client is a well known physician in the greater Boston area. Nearly six years ago he was accused of touching a young child on her buttocks and on her vagina. The charges did not actually come to fruition until about two years ago. The man was charged with two counts of<a href="https://www.neymanlaw.com/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-child-under-fourteen/"> indecent assault and battery on a child under the age of 14</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13b-indecent-assault-and-battery-on-a-ch/">G.L. c. 265 section 13B</a>. This is a felony in Massachusetts. This charge cannot be continued without a finding and there is a requirement that anyone convicted of this offense register with the Massachusetts Sex Offender Registry Board. Attorney Neyman was hired to defend the doctor. Through a very thorough pretrial investigation we were able to show that the allegations were false and that the alleged incident never occurred. Today, we succeeded in getting all charges dismissed. </p>

One of his students made a complaint that during class he asked her if any boys had ever “jerked off” on her breasts before. The student immediately left the class and located a school administrator and told him what had just happened. The police came to investigate and referred the case to the district attorney’s office for prosecution. The man was charged with <a href="/practice-areas/sex-crimes/annoying-and-accosting-a-person-of-the-opposite-sex/">annoying and accosting</a>, a violation of <a href="/massachusetts-general-laws/massachusetts-g-l-c-272-53-b-disorderly-persons/">G.L. c. 272 section 53</a>. Attorney Neyman was hired. Today, the case was dismissed. There is another similar matter that is pending that also involves this teacher.</p>

In three months all charges will be dismissed. There is no requirement that he register as a sex offender. </p>

The first case involved him flashing his genitals to an unsuspecting woman in a local convenience store. The complaint did not issue. Rather, the matter was continued to be dismissed on the condition that he not have any criminal legal problems for one year. Unfortunately, a few month later he exposed himself again, this time at another story. While exposing himself he masturbated and ejaculated on a woman. He was charge with<a href="/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-person-aged-fourteen-or-older/"> indecent assault and battery</a> under <a href="/massachusetts-general-laws/g-l-c-265-13h-indecent-assault-and-battery-upon-a-person-fourtee/">G.L. c. 265 section 13H</a>. He was also charged with <a href="/practice-areas/sex-crimes/open-and-gross-lewd-and-lascivious-behavior/">open and gross conduct</a>. A charge of <a href="/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault and battery by means of a dangerous weapon</a> also issued under <a href="/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15A</a>. We had our client evaluated for a risk assessment by a forensic psychologist. Her report gave the judge confidence that a resolution by means of a <a href="/practice-areas/massachusetts-continuance-without-a-finding/">continuance without a finding</a> (CWOF) is the appropriate solution to this case. The case was in fact continued without a finding for two years on the condition that our client undergo regular mental health counseling. </p>

In November last year he went on a date with a woman he met through a dating app. The date went well however our client had no interest in following up with the woman. He politely made that clear to the woman and the two parted ways. For some reason the woman became upset and contacted the police stating that our client had become sexually aggressive with her and that he touched her inappropriately on her buttocks. Rather than being charged with <a href="/practice-areas/sex-crimes/indecent-assault-and-battery-on-a-person-aged-fourteen-or-older/">indecent assault and battery</a> under <a href="/massachusetts-general-laws/g-l-c-265-13h-indecent-assault-and-battery-upon-a-person-fourtee/">G.L. c. 265 section 13H</a> our client was charged with <a href="/practice-areas/sex-crimes/annoying-and-accosting-a-person-of-the-opposite-sex/">annoying an accosting</a> under G.L. c. 272 section 53. To its credit, the district attorney’s office obtained security videos. The videos strongly refuted much of what the woman complained about. As such, our client was given <a href="/legal-resources/pre-trial-probation/">pretrial probation</a> under G.L. c. 276 section 87. All charges will be dismissed in a few months.</p>
