<p>In December of 2025, police in a suburban Boston town conducted a sting operation to infiltrate a human trafficking operation. An undercover officer entered a “massage” establishment. Purportedly, an employee offered him a hand job for $60 and, alternatively, oral sex for $100. The undercover officer declined but asked to arrange for full sex on another day. He was directed to the front desk where he made a reservation. Armed with this information the police obtained a search warrant that was executed the next day. In the course of the search a woman identified as the owner of the establishment was interviewed. Just a few days later she was charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">deriving support from a prostitute</a>, G.L. c. 272 section 7, keeping a house of prostitution, G.L. c. 272 section 24 and trafficking a person for sexual servitude, also known as <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/human-trafficking-and-sexual-servitude/">human trafficking</a>, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-50-trafficking-of-persons-for-sexual-ser/">G.L. c. 265 section 50</a>. Rather than summons the woman the police obtained an arrest warrant. However, unbeknownst to the officers the woman went home to China to visit family. She did not know about the warrant for several months. Fully intending to honor her obligations to the legal system the woman purchased an airline ticket back to the United States. Fearing that the pending warrant would result in her arrest at the airport she hired our office. Today, we succeeded in getting the <a href="https://www.neymanlaw.com/practice-areas/default-warrant-removal/">warrant vacated</a>. The woman does not have to worry about being arrested upon her arrival. </p>

He was approached by a woman asking him if he had interest in having sex in exchange for a fee. He stated that he did. He was not aware that the woman was an undercover police officer. He was summonsed for a charge of <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sex for a fee</a>, a crime under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53A</a>. Our office was hired. Today, we convinced a judge to impose <a href="https://www.neymanlaw.com/practice-areas/pre-trial-diversion/">diversion </a>under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-276a-pretrial-diversion/">G.L. c. 276A</a>. This result is a non-conviction and will not adversely impact our client’s citizenship application. </p>

<p>Our client is a construction company executive who graduated college less than 2 years ago. He has no criminal history. In May of this year he responded to an advertisement online to a woman claiming to provide sexual services in exchange for money. A meeting location was provided to our client along with a cell number. He was told to drive to that address. He was further advised that when he arrived he was to text the number and meet up with the woman to pay her for sexual services. He did this only to find out that the woman was an undercover police officer participating in a wide scale sting operation throughout Eastern Massachusetts. The incident was captured on audio and text messages confirmed the intentions of our client. He was charged with soliciting <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sex for a fee</a> which is a crime under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53</a>. Attorney Neyman was hired. He filed a motion for pre-arraignment diversion under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-276a-pretrial-diversion/">G.L. c. 276A</a>. The motion was allowed. Our client was ordered to complete a prostitution awareness course  which he did prophylactically. All charges are being dismissed prior to arraignment.</p>

Within minutes a woman approached his window and asked him if he was interested in having a quote “date”. The man said yes and a fee was negotiated for oral sex. Unbeknownst to the man, the woman was an undercover police officer. He was summoned to court charged with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/">sex for a fee</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53</a>.  Notwithstanding his age, our client had a relatively significant criminal past. Nevertheless, the judge agreed to <a href="https://www.neymanlaw.com/practice-areas/massachusetts-continuance-without-a-finding/">continue the case without a finding</a> (CWOF) for 60 days. All charges will be dismissed provided he remains free from criminal legal trouble during that time period. </p>

After a minute or two of negotiations our client was summonsed for a <a href="https://www.neymanlaw.com/practice-areas/clerk-s-hearings/">clerk magistrate hearing</a> seeking to charge him with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/">sex for a fee</a> under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 section 53</a>.  Had a criminal complaint been issued against our client he would likely have difficulty obtaining citizenship.  Our office succeeded in convincing the magistrate not to issue the criminal complaint. </p>

When our client went to meet with the supposed prostitute he was greeted by an undercover police officer. Our client went to an agreed location only to learn that the soliciting party was actually an undercover police officer. He was given a summons charging him with <a href="https://www.neymanlaw.com/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sex for a fee</a> under G.L. c. 272 section 53. Attorney Neyman was hired to defend the man. We were able to get a general continuance prior to arraignment provided that the man successfully complete a prostitution awareness course. No arraignment also means that our client will not have a PCF number. </p>

                <content:encoded><![CDATA[ <p>Several weeks ago an urban police task force formulated a sting operation targeting people soliciting prostitutes. Two undercover police officers from different departments posed as prostitutes working the streets in a neighborhood known for high volume of prostitutes and people soliciting sex for a fee. Our client was driving through that neighborhood around 1:00 in the morning. He requested oral sex offering twenty dollars for such services. The undercover directed him around a corner where he was met by several police officers. He was identified and summonsed for a <a href="/practice-areas/clerk-s-hearings/">clerk magistrate hearing</a> charging him with <a href="/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sex for a fee</a> in violation of G.L. c. 272 section 8. We represented him and convinced the magistrate not to issue the complaint. </p>

Our client responded and negotiated various sex acts for a specific price. The defendant and undercover officer agreed to meet at a suburban Boston hotel. Our client arrived, introduced himself and offered the negotiated money. He was arrested by the undercover officer and backup officers. He was charged with <a href="/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sexual conduct for a fee</a> under <a href="/massachusetts-general-laws/massachusetts-g-l-c-272-53a-engaging-in-sexual-conduct-for-a-fee/">G.L. c. 272 Section 53A</a>. The officers posing as prostitutes saturated the internet with solicitations for all types of sexual services. The officers obtained a cell phone for final contact with the customers and engaged in extensive texting negotiating services, fees and meeting places. Our client, a local university professor was one of the customers. He was charged with <a href="/practice-areas/sex-crimes/prostitution-pimping-and-soliciting/">sex for a fee</a> under G.L. c. 272 section 53A. Our client has a PhD in several disciplines and has been in this country for several decades. However, the defendant is not a citizen and anything short of a dismissal would result in his deportation and loss of his tenured position. The man hired Attorney Stephen Neyman to represent him. We were able to convince the district attorney’s office to nolle prosse the case. </p>
