Negligent Operation of a Motor Vehicle Charges Against Truck Driver Diverted Prior to Arraignment

In November of last year our client, a commercial truck driver, was completing a string of overnight drives. He was heading to Maine with a cargo that he initially picked up on the west coast. Around 3:30 in the morning, while driving on a major interstate in Massachusetts, our client fell asleep behind the wheel of the truck. Police were dispatched to the scene and found our client sitting in the front seat of the truck unharmed. The truck however ended up deep into a wooded area. Our client was ultimately charged with negligent operation of a motor vehicle in violation of G.L. c. 90 section 24. Were he to be arraigned on this case he would have become unemployable as a commercial driver. Our office was hired. Today, we were able to convince the district attorney’s not to arraign our client. Instead, the case was diverted for three months to allow him to complete a driver’s safety course. Once the program is completed the case will be dismissed, again, prior to arraignment.

Continuance Without a Finding for Insurance Agency Owner Charge With Reckless Driving After Road Rage Incident

Our client owns a large insurance agency. In March of 2022 he was driving behind someone operating at least 20 mph below the posted speed limit. Our client attempted to pass him on several occasions. However, the other driver kept blocking our client deliberately, not letting him pass. An exchange of middle fingers followed. Suddenly, our client proceeded to attempt to pass the man notwithstanding the efforts to block him. This resulted in our client striking the other vehicle causing a significant amount of damage. Moreover, all of this was caught on video. Our client was charged with reckless operation of a motor vehicle in violation of G.L. c. 90 section 24. Today, we were able to get the case continued without a finding. More importantly, the judge agreed with our request to recommend that the registry of motor vehicles not suspend our client’s driver’s license.

Charges of Negligent Operation of a Motor Vehicle Against Restaurant Worker to be Dismissed

The defendant is a restaurant worker with no criminal record. In January of last year she was driving home from a party at a high rate of speed. She lost control of her car, injuring her passenger. She also knocked over a granite mailbox and totaled a parked pickup truck. The police arrived. They reconstructed the accident and charged her with negligent operation of a motor vehicle in violation of G.L. c. 90 section 24. Today the case was continued without a finding (CWOF) for a few months. The case will be dismissed and she will have no criminal record.

Several months ago our client was observed by police officers driving the wrong way in a rotary. In the process of doing so our client struck a vehicle being driven by someone else. The man was charged with violating G.L. c. 90 Section 24. He hired Attorney Neyman to represent him. After one court appearance our office was able to get all charges dismissed. The judge agreed with the substance of our motion that the police had not provided sufficient information with which to sustain the criminal allegation.

Our client is a physician living in the Merrimack Valley. Several weeks ago motorists on a major interstate highway made 911 calls complaining of someone driving erratically and nearly causing several traffic collisions. The police located the vehicle and made similar observations. The officers stopped the vehicle and ultimately charged our client, a local physician with operating to endanger in violation of G.L. c. 90 Section 24. Attorney Neyman was hired to represent him. Less than one month ago police in a southeastern Massachusetts town responded to a call for a motor vehicle that had run off the roadway and into a wooded area. Witnesses to the incident told the police that they had observed the driver operating erratically and in a manner that put the public at risk. The vehicle was swerving from lane to lane without signaling and nearly hitting several other moving cars. Based on these reports and a reconstruction of the accident using photographs and various measurements of skid marks as well as pole camera evidence the defendant was charged with violating G.L. c. 90 Section 24. Attorney Neyman was hired and scheduled this case for trial today. All charges were dismissed.

Charges of Negligent Operation of a Motor Vehicle Dismissed Prior to Arraignment

The Massachusetts State Police Reported that on Sunday, June 11, 2017 at 2:30 a.m. a cruiser was dispatched to an accident scene. When they arrived the defendant was found being evaluated by Boston EMS. Witnesses quickly alerted the police that the defendant was operating his motor vehicle at a high rate of speed on a narrow street and that he collided with parked cars causing extensive damage. An investigation revealed that the vehicle the defendant was driving was unregistered, uninsured and that he had attached plates belonging to another vehicle. He was charged with negligent operation G.L. c. 90 Section 24, uninsured G.L. c. 90 Section 34, unregistered operation G.L. c. 90 Section 9 and attaching plates to conceal G.L. c. 90 Section 23. Attorney Neyman was hired. Today, the negligent operation was dismissed prior to arraignment and the remaining charges were dismissed after arraignment.

On August 19, 2016 members of the Massachusetts State Police responded to a crash scene. They observed two cars, one with rear end damage and the other with front end damage. The driver of the vehicle with rear end damage was taken to the hospital for his injuries. Witnesses to the incident stated that the car with front end damage ran a stop sign and struck the other vehicle. The witnesses further stated that the responsible driver seemed to be impaired and passed out after the collision. This man was charged with negligent operation of a motor vehicle, G.L. c. 90 Section 24. His family hired our office to defend him. Today, Attorney Neyman was able to get this charge dismissed.

The defendant is a film maker living in Boston, Massachusetts. Several weeks ago he was traveling through the South Station Tunnel where he was observed cutting across several lanes of traffic nearly causing a multiple car collision. A Massachusetts State Trooper witnessing the event pulled him over and charged him with operating negligently so as to endanger, a crime under G.L. c. 90 Section 24. Pretrial Probation for Physician Charged With Operating to Endanger

The defendant is a physician who in October of 2015 was charged with negligent operation of a motor vehicle in violation of G.L. c. 90 Section 24. The victim claimed to be severely injured as a result of this incident and objected to any resolution of the case that did not involve a conviction. Any form of conviction or admission for the defendant could result in a loss of her medical license. Notwithstanding the objection of the victim, today Attorney Neyman was able to secure pretrial probation pursuant to G.L. c. 276 Section 87 for the defendant. She will have no criminal record and her medical license will not be impacted.

Operating to Endanger Charge Against Health Club Manager Dismissed

The prosecution alleged that in January of this year a Chelmsford, Massachusetts police officer responded to the scene of an accident. Witnesses to the incident stated that the defendant was driving his car at a very high rate of speed along narrow roads, traveling on lawns, hitting mailboxes and sideswiping parked cars. The responding officers saw damage to the defendant’s car consistent having been involved in the activity described by the witnesses. Charges of operating negligently so as to endanger in violation of G.L. c. 90 Section 24 issued. Attorney Neyman was retained to represent the defendant. Today, all charges were dismissed.

Operating to Endanger Case to be Dismissed

On December 26, 2015 a Dover, Massachusetts police officer was dispatched to a motorcycle crash. The officer arrived to find the vehicle heavily damaged and debris spread over the road. An investigation and an eyewitness account revealed that the driver of the vehicle was proceeding at a high rate of speed, lost control of the motorcycle and crashed. The driver fled the scene. A cell phone found at the scene led the officers to the defendant who was located in a Rhode Island hospital. He had sustained severe injuries in the crash. The driver was interrogated by the police and he confessed to having driven the motorcycle. Multiple motor vehicle charges were filed as well as operating to endanger under G.L. c. 90 Section 24. The defendant hired Attorney Stephen Neyman. Today, the operating to endanger charge was continued without a finding. It will be dismissed in six months.

He was on his way back to school and travelling on Route 95 when he briefly fell asleep behind the wheel of his car. The car crashed. Police immediately responded to the scene. After a brief investigation the accused was cited for operation negligently and operating so as to endanger under G.L. c. 90 Section 24. Local Electrician Not Ordered to Pay Restitution After Hearing Following Operating to Endanger That Was Continued Without a Finding

Several months ago our client received a continuance without a finding on a very serious motor vehicle crime that resulted in personal injuries and property damage. A condition was that out client pay restitution in an amount to be determined after a hearing. The victim claimed that he was owed in excess of eight thousand dollars in restitution stemming from this incident. After a contested and heated hearing, the judge denied the victim’s request and our client does not have to pay any restitution.

On March 22, 2013 Braintree, Massachusetts police officers observed a Jeep being driven by a man approach them at a high rate of speed. The vehicle crossed the center divide on several occasions. The officers then followed the vehicle and noticed several more erratic driving maneuvers. The operator of the Jeep then lost control, crossed a sidewalk and proceeded into a snow bank at a local church. The Jeep eventually came to rest when it struck a tree. Officers immediately contacted the driver and cited him for reckless operation of a motor vehicle. He was arraigned months later and eventually hired Attorney Stephen Neyman to represent him. Today, all charges were dismissed.

The prosecution alleged at on April 28, 2009 at 2:15 in the morning Boston police responded to a radio call for a motor vehicle accident in downtown Boston. The office observed a vehicle on a grass island that was obviously just in a crash. A witness stated that the vehicle was traveling at a high rate of speed, that the driver lost control and that the vehicle crossed over an island and uprooted a tree. The driver then fled and got into a cab. The case was set for trial today. Attorney Neyman was able to get all charges against the defendant dismissed.
