<p>Several  months ago we succeeded in getting charges of <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/strangulation-or-suffocation/">strangulation</a> <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-15d-strangulation-or-suffocation/">G.L. c. 265 section 15D</a> and <a href="https://www.neymanlaw.com/practice-areas/domestic-violence/">domestic assault and battery</a> <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a> dismissed for our client. He wanted us to file a petition to seal to minimize the chances of prospective employers accessing this information. We filed the petition under G.L. c. 276 section 100C. The judge allowed the petition over the objection of the government. </p>

<p>Our client is a non-citizen who, back in July was charged with domestic assault and battery, <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a> for slapping his wife and throwing her to the ground. The police respond to the wife’s 911 call. When they arrived she was visibly shaken but showed no signs of having been physically assaulted. She claimed that during an argument our client became violent. She ran out of the house seeking help after he took her cell phone from her to prevent her from calling the police. This is a felony in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-268-13b-intimidation-of-persons-connected-to/">G.L c. 268 section 13B</a>. While outside screaming, a neighbor permitted her to use his phone. Our client was arrested and hired Attorney Stephen Neyman to represent him. We argued that the victim’s 911 call was inadmissible. The judge agreed and excluded the recording. The wife then embraced her marital privilege and we succeeded in getting all charges dismissed. </p>

At that time she was represented by another law firm. Given that she was not a citizen at that time the deal was one that she felt she had to accept. Many years later this disposition had a negative impact on her life. She is a school teacher and this document kept surfacing anytime she sought employment even though she is now living on the west coast. Accordingly, she hired Attorney Stephen Neyman to seal this document. Today, over the objection of the district attorney’s office a judge sealed the file. </p>

<p>This past summer our client, a flight attendant with a major airline company, was visiting Massachusetts with his wife who was also a flight attendant. The two had been drinking for several hours and decided to walk it off and get something to eat. During their walk and argument ensued. The argument turned physical. Several witnesses including a police officer claimed to have observed our client strike his wife, throw her to the ground and push her. He was immediately arrested and charged with <a href="https://www.neymanlaw.com/practice-areas/domestic-violence/">domestic assault and battery</a> in violation of <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a>.  Our office was hired immediately. We secured a personal recognizance release for our client as well as permission for him to return to Florida where he lives and where he is based for employment. The man has a pending application and interview to become a pilot for a major commercial airline. Any conviction or attribution of responsibility for this crime would end his employment and well as his professional aspirations.  Today, attorney Neyman succeeded in getting all charges dismissed. </p>

<p>Our client is an extremely well educated mother of three children. She and her ex-husband have been battling in the Probate Court for several years now. At every stage of the Probate Court process our client has enjoyed great success.  Her ex-husband cannot accept defeat. In as much as he has been unable to prevail in the Probate Court he started strategically applying for restraining orders and applying for criminal complaints.  After successfully obtaining a restraining order he  met with local police and detailed several violations alleged to have been committed by our client. An overly aggressive and unusually invested police officer assisted him and brought an application for a complaint against our client charging a <a href="https://www.neymanlaw.com/practice-areas/restraining-orders/">violation of a 209a restraining order</a> under G.L. c. 209A section 7 and <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-43a-criminal-harassment-punishment/">criminal harassment</a> under G.L. c. 265 section 43A. The man had an excellent lawyer appear on his behalf at the <a href="https://www.neymanlaw.com/practice-areas/clerk-s-hearings/">clerk magistrate hearing</a>. Our office successfully argued that the factual basis for the issuance of a criminal complaint was non-existent. The clerk magistrate agreed with us and he did not find probable cause. The complaints did not issue. </p>

<p>Our client is a self-employed software Construction with over 30 years experience. His business is in the process of going public. In April of this year police were called to his home for a complaint of a <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/">domestic assault and battery</a> and strangulation.  The facts of the case were dubious in that the alleged victim in the case recanted on several occasions and showed no visible signs of injury when the police investigated her complaint. Unfortunately she made a 911 call that a judge deemed partially admissible or the case to go to trial. The <a href="https://www.neymanlaw.com/practice-areas/violent-crimes/strangulation-or-suffocation/">strangulation </a>count is a felony under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-15d-strangulation-or-suffocation/">G.L. c. 265 section 15D</a>. We were able to get that count dismissed. The remaining count, domestic assault and battery under <a href="https://www.neymanlaw.com/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a> was continued without a finding (CWOF) and will be dismissed in 60 days. </p>

After the man left, our client and his wife decided to go to a local restaurant to discuss the situation. They had a significant number of drinks and went home where they began to argue over the evening’s events. Our client ended up putting his hand to the wife’s neck. In doing so he interfered with her breathing. He also hit her and threw her to the ground. The wife called her father and sister who in turn called the police. The police arrived, accumulated evidence and arrested our client. Our client slammed a door on the woman and threw a lamp on her. The woman had security cameras in her home that recorded the entire incident. Our client was charged with <a href="/practice-areas/domestic-violence/">domestic assault and battery</a> under <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a> and <a href="/practice-areas/violent-crimes/assault-and-battery-by-means-of-a-dangerous-weapon/">assault and battery by means of a dangerous weapon</a>, a felony under <a href="/massachusetts-general-laws/g-l-c-265-15a-assault-and-battery-with-a-dangerous-weapon/">G.L. c. 265 section 15A</a>. Attorney Neyman succeeded in getting the case continued without a finding (<a href="/practice-areas/massachusetts-continuance-without-a-finding/">CWOF</a>). On two occasions, once in 2021 and a second time in 2023, the estranged partner claimed that our client struck her. He was charged with two different cases of domestic assault and battery under <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a>. Attorney Neyman was hired. This process involved obtained sealed and privileged probate court documents, DCF records, several restraining order hearing transcripts and witness investigation. After more than 3 years we were finally able to get this case to trial. Today, a verdict of not guilty entered on both cases. </p>

His girlfriend was present and officers separated the two and met with each separately. Their discussions led them to believe our client had thrown the victim to the ground several times. Our client was arrested and charged with <a href="/practice-areas/domestic-violence/">domestic assault and battery</a> in violation of <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a>. Attorney Neyman recognized that the victim had a 5th Amendment privilege and a short non-binding bench trial was scheduled. Today, the victim did not appear in court but did indicate through her attorney that she intended to exercise her constitutional right not to testify. All charges were dismissed. </p>

In March of this year he and his wife who was nearly nine months pregnant got into an argument. The wife became violent in the home and started throwing and breaking all kinds of household objects. Some of these struck our client. The noise became loud enough to alarm several neighbors. The wife then left the home, slammed the door and began verbally insulting and yelling at our client from the front lawn. The defendant tried to calm his wife down and gently tried to move her from the lawn into the house. A neighbor witnessed this an interpreted these actions as an assault on the wife. He called the police. The officers responded, arrested our client and charged him with <a href="/practice-areas/violent-crimes/">domestic assault and battery on a pregnant person</a>. This is a felony in Massachusetts in violation of <a href="/massachusetts-general-laws/g-l-c-265-13a-assault-and-battery/">G.L. c. 265 section 13A</a>. Our office was hired. Attorney Neyman convinced the district attorney’s office to give <a href="/legal-resources/pre-trial-probation/">pretrial probation</a> under G.L. c. 276 section 87 to our client. The case will be dismissed in a few months.</p>

After a few dates the woman suspected that our client had another girlfriend. She followed him and incorrectly believed that her suspicions were confirmed. She confronted our client who adamantly denied the accusations. She did not believe him. He attempted to walk away from her and she started to scream and call the police. She hysterically claimed that our client had “beat the shit out of” her. He was arrested and charged with domestic assault and battery in violation of <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a>. After being arraigned our client left the United States and returned to his home country. When he attempted to return for his court appearances he learned that his student visa had been revoked. He then hired Attorney Stephen Neyman to represent him. We convinced a very compassionate judge to permit our client to appear by Zoom for his pretrial and a scheduled trial date. Today, the case was dismissed and our client was allowed to appear by Zoom. </p>

She went to the hospital and there she made a similar report. The defendant, an engineer, was arrested and charged with domestic assault and battery under <a href="/massachusetts-general-laws/massachusetts-g-l-c-265-13m-assault-or-assault-and-battery-on-a/">G.L. c. 265 section 13M</a>. The woman took out a <a href="/practice-areas/restraining-orders/">restraining order</a> against our client under G.L. c. 209A. The wife later hired her own lawyer and opted to take her marital privilege and not testify against our client. She also agreed to vacate the restraining order. As a result, today the case against our client was dismissed. </p>
